2) Our agreement with
you
Our website and price comparison technology
has been designed to cater for two types of users.
- A private individual wanting
to use our website and price comparison technology seeking treatment
on your own behalf and/or on behalf of somebody else.
In this scenario you are not involved in any way in searching for therapists
as a business and from here onwards will be referred to as the 'patient'.
- A professional therapist
deciding to advertise their business on this site from here onwards will be referred
to as the 'therapist'.
In both cases you agree to the terms
of our Privacy & Security Statement
As a patient, you are permitted to use
our website and price comparison technology to find the most competitive
prices from the leading UK therapists online.
2.1) Our services for
the patient
TherapyChecker.com is not a broker -
we are a Search Engine to help individuals find therapists local to
you at a price suiting your needs. Currently we offer price comparison
services for therapist services with geographical location, and an online
forum for you to share your health-related issues
2.2) Your responsibility
as a patient
In order to get effective search results
for your therapist search, you will need provide a postcode or city,
and select the therapy type (optional) and select a symptom you are
suffering from (optional). The more information you provide the narrower
your search will be. The advanced tab allows for a more restrictive
search with additional search criteria.
Although we do our best to verify the
credentials of every professional therapist practitioner on our site,
the ultimate responsibility lies with you and you must endeavor to clarify
with the therapist provider any queries you may have to until you are
satisfied. We at TherapyChecker.com hold no responsibility or liability
for any treatment sought via this site, and you agree to bear all responsibility
for any treatment sought.
2.3) Our services for
the therapist
As a therapist you can upload your profile
with all the therapy services you offer. With therapychecker.com,
you are not confined to offer one therapy service, but can add all other
therapy provisions you provide making us unique in the sense that you
can advertise multiple therapy provisions. This allows therapist/organisations
with multiple service offerings to list them all, thus increasing the
chances of being searched against by a patient and being listed in the
search results.
For example if you are an osteopath,
but are also trained to provide acupuncture, then you can select both
when adding and updating your profile. If a patient searches for
either of the two you therapy types you will still be listed in the search results page,
providing that you meet the other search criteria for example falling
within the postcode range or geographical region.
2.4) Your responsibility
as a therapist
It is your responsibility to be honest
and provide accurate information reflecting the therapy services you
offer with proof of certification in areas that warrant this for practicing
purposes, for example osteopathy. We will ask for proof of certification
after registration and you will be required to scan and send all relevant
certificates to us via email clearly identifying your username at support@therapychecker.com
or when logging on and using the manage upload documents functionality (where you may upload a maximumu of 8 documents).
You agree that your profile will not
be visible in the search results until the relevant qualifications/credentials have
been supplied to us.
The following is a partial list of the
kind of Content that is illegal or prohibited on the Site. Therapychecker
will investigate and take appropriate legal action in its sole discretion
against anyone who violates this provision, including without limitation,
removing the offending communication from the Service and terminating
the Membership of such violators. It includes Content that:

patently offensive to the online community, such as Content that promotes
racism, bigotry , hatred or physical harm of any kind against any group
or individual;

harasses or advocates harassment of another person;
-
involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
-
promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
-
promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ;

displays pornographic or sexually explicit material of any kind;

provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
-
engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Any images that are loaded must not be patently offensive to the online community, such as an image that promotes racism, bigotry , hatred or physical harm of any kind against any group or individual, displays pornographic or sexually explicit material of any kind;
3) Subscription charges
Therapychecker offers two types of subscription,
a monthly subscription and a quarterly three months subscription.

The monthly subscription will be charged at £ 18 per month
-
The quarterly (three months) subscription will be charged at £49 per quarter
Registration for new members will include
one month's free subscription. For the one month free subscription to take effect,
we will refund the equivalent of a single month back to your account within 48 hours
after you register. This means if you subscribe for the monthly subscription, you will be refunded £ 18
within 48 hours after registering. After the first trial month period expires you will then be billed £ 18 every month.
Likewise if you subscribe for a quarterly three month subscription, the amount that will be refunded within 48 hours
will be £16.33. This amount is deduced by dividing your quartely subscription amount by 3 (49 / 3) to determine
the amount to be refunded for the first trial month. This means you are actually paying £ 32.67 for the first quarter.
After the first 3 month subscription quarter, you will then be billed £ 49 from then onwards per 3 month subscription cycle.
At the end of each subscription cycle
depending on which subscription you choose, you will automatically be
billed for the next subscription period unless you choose to cancel. In the case that you do
choose to cancel, your subscription will no longer be automatically renewed.
4) Cancellation policy
6.1 To cancel your subscription, please
login and select the 'My Account' tab, select the 'Current Membership'
button, and select the cancel subscription hyperlink. Then proceed to
complete the cancellation form and click 'submit' button upon completion.
6.2 Please note the current subscription
will be cancelled when the existing subscription expires. This
means that the cancellation policy will take effect when the current
subscription ends. For example if you are on a monthly subscription,
and you cancel on the second week of that month, you will have the remaining
duration for that month before your existing subscription is cancelled.
At the end of the month, your subscription will no longer automatically
be renewed.
5) Refund policy
Apart from the monetary amount refunded for the first free month
as described in secton (3), no refunds will be given either
in whole or part for payments make by credit or debit card.
6) Other things to Know
6.1) Indemnity
You the patient or therapist will defend,
indemnify, and hold harmless our officers, directors, employees, agents
and third parties, for any losses, costs, liabilities and expenses (including
legal costs) relating to or arising out of your use of our service,
including any breach by you of the terms of this agreement.
6.2) Third party links
You the patient or therapist will not link to other websites by means
of hyperlinks published on this website or e-mailed to you as part of
our service. These websites are owned and operated by third parties.
We accept no liability for any statements, information, products or
services that are published on or may be accessible through third party
websites.
6.3) Availability
You acknowledge that it is technically
impossible to provide the Site free of faults and that we do not undertake
to do so; that faults may lead to the temporary unavailability of the
Site; and that the operation of the Site may be adversely affected by
conditions and performances outside our control, including, without
limitation, transmission and telecommunications links between us and
you and between us and other systems and networks. We and/or our suppliers
may make improvements and/or changes in or to the Site at any time.
6.4) Force Majeure
We accept no liability for any temporary
or even permanent unavailability of the Site arising from events of
any kind or circumstances which are outside our control even though
we shall use all reasonable endeavours to minimise or mitigate the effects
of any such force majeure but this will not release you by reason of
such force majeure from any obligation to indemnify or make any payment
due under these Terms and Conditions.
6.5) Amendments to our
terms
We reserve the right to amend our terms
and conditions at any time. The amended terms will be effective from
the date they are posted on our website.
6.6) Website Content
We have taken every reasonable step
to make sure the information contained in this website is accurate and
up-to-date. However, we can accept no liability for any errors or omissions.
We reserve the right to add, amend or delete information from this site
at any time.
Whilst we take every reasonable step
to counteract viruses and other things with contaminating or destructive
properties, we can give no warranty that this site and its content are
free from viruses or anything else that has such contaminating or destructive
properties.
